Dear Members, supporters, owners of Planas del Rey,

A member of “Unidos Planes del Rei” has published a text that pleads in favor of the creation of a community of owners.

We have for ten years rarely agreed with this association and this time again, and as long as we are allowed to express ourselves without continually threatening us with legal attacks, we will continue to say what we think is right and good for Planes del Rei.

We will try to respond to his proposals.

First of all. – The possibility of creating a Community of Owners in Planas, as it has already been said several times and in the call itself, IS NOT FOR THE PURPOSE OF DOING PLANAS MAINTENANCE like the old ECU and this will be clarified in its STATUTES if it is made official.

Since 2013, you have changed your mind so many times that many people doubt you.
And even if we still make the effort to believe you, you appear to be the ally of the Town Hall.
The Town Hall has just voted the reparcelation project for the nth time.
We’ll see what the Bureau de Falset decides… Let’s wait

Secondly. – The constitution of a Community of Owners is normal in a timeshare where there are COMMON ELEMENTS

In L’Hospitalet de l’Infant, Montroigt del Camp, Cambrils, etc. there are many common elements and yet in none of these towns there is a COMMUNITY OF OWNERS. So why in Planas should it be different??
We only own houses purchased before a notary. Not multi-owners.
The Town Hall owns the green spaces, the roads, the swimming pool, and all the infrastructures. (45% of Planas territory)
WE ARE NOT A PRIVATE URBANIZATION.

Third. – With its creation, a democratic representation of ALL the owners was born, since UNIDOS, SOS and Avanza Pratdip represent only a part of them.

It is still the luxury of democracy. You can choose between several solutions to manage the city.

  • Some will choose AVPR SOSPlanas because they have seen the results we have obtained with justice for more than 12 years
  • Some will choose Unidos because they don’t believe in justice and they think Planas problems can be solved over a good meal with friends (they can see the results since 2013)
  • Finally when the municipal elections come, we will all be happy to turn to our political party, “Avança Pratdip” and its courageous “Regidores” hoping that they will become the majority.

What you are proposing is quite simply the SINGLE PARTY, antechamber to all dictatorships.

Fourth. – Greater STRENGTH is achieved against third parties, including the City Council

The only FORCE recognized by the Municipal Council and its Mayor is JUSTICE.
If it had not been for the sentence of July 21, 2016, we would continue, all of us, inhabitants of Planes to pay taxes to the EUCC
(1200€ on average for a house with 1000m2 of land. in addition to water and household waste)
The average annual budget of the EUCC was €230,000 (€1,380,000 therefore saved since 2016…)

Fifth. – Neither SOS, nor UNIDOS, nor AVANZA have the legal capacity to represent ALL owners. If you want to decide something in the urbanization that INVOLVES all the neighbors, it is only possible to set up a COMMUNITY OF OWNERS. That is to say that the sum of SOS, UNIDOS and AVANCA cannot decide anything that involves ALL the owners…, instead a Community of Owners… YES

The association of vecinos of Planes el Rei (SOSPlanas)

  • was officially created 11 years ago.
  • has official statutes written by a legal professional.
  • these statutes have been published in the official gazette (BOE) in compliance with legal and democratic practice.
  • ALL OWNERS of Planes del Rei have a vocation to be part of our association.

They even have a vocation if during the Annual General Meeting the others decide and if they wish to become “vocal”, treasurer or treasurer, secretary, vice-president, president.
In 2018, the Town Hall tried to dismiss SOS by questioning the legitimacy of our association to request the application of the sentence of July 21, 2016.
The TSJ of Catalonia proved them wrong in a firm sentence of January 31, 2020 and confirmed our REPRESENTATIVENESS.

It is a difficult challenge to achieve alone, but if it is not achieved, this Urbanization will end in FAILURE

Mister, the Town Hall in the person of its Mayor has always refused to apply the law.

  • The liquidation of the EUCC is still not done.
  • the Judges write black on white that the Town Hall was the GUARDIANSHIP of the EUCC. The Mayor refuses to admit it..
  • The Town Hall still refuses to assume the minimum services.
  • The Town Hall would like to carry out these famous re-urbanization works that no one wants and under scandalous and illegal conditions. Basically 100% for owners.

This is why, considering that there was no more room for negotiation, our association, in consultation with its lawyer, decided to bring the case before the criminal court.
